The Best Interests of the Child Standard in California

Every custody decision in California turns on a single overarching question: what serves the best interests of the child? California Family Code Section 3011 establishes this framework and defines the factors courts must weigh.

Those factors include the child’s health, safety, and welfare; the frequency and nature of each parent’s involvement in the child’s daily life; any history of domestic abuse or substance use by either parent; and each parent’s demonstrated willingness to support the child’s relationship with the other parent. California law explicitly prohibits courts from using a parent’s sex, gender identity, gender expression, or sexual orientation as a factor in custody decisions.

Children aged 14 or older may express a preference, and courts can consider that preference as one factor among many. The court, however, retains full authority to make the determination it finds best serves the child’s overall wellbeing.

To modify an existing order, the requesting parent must demonstrate a material change in circumstances since the original order was made and show that the proposed change serves the child’s interests.
